These "Terms and Conditions of Purchase and Sale" and "Terms and Conditions" were last updated on 11/07/2022 and apply to citizens and legal permanent residents of the European Economic Area and Switzerland
1. General provisions
1.1 These E-shop Rules (hereinafter referred to as the "Rules") are a legally binding document for the Buyer and the Seller (hereinafter referred to as the "Seller"), setting out the rights and obligations of the Parties.
1.2 The Seller reserves the right to change, amend or supplement these Terms and Conditions at any time. The Buyer shall be informed of any changes to the Terms and Conditions on the website of the e-shop.
2. Conclusion of the sale and purchase agreement
2.1 The contract of sale between the Buyer and the Seller shall be deemed to have been concluded when the Buyer forms and submits an order for the goods in the online shop, having first read these Rules.
3. Seller's rights
3.1 In the event of serious circumstances, the Seller may suspend temporarily or completely the operation of the e-shop without prior notice to the Buyer.
3.2 If the Buyer attempts to undermine the operation, stability and security of the e-shop or violates his/her obligations, the Seller shall have the right to restrict or suspend the Buyer's access to the e-shop without notice.
4. Obligations of the Seller
4.1 The Seller undertakes to make available the services of the online shop, the conditions of operation of which are set out in these Terms and Conditions.
4.2 The Seller undertakes to deliver the Goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the terms and conditions set out in these Terms and Conditions of Sale.
4.3 Where, due to unforeseen circumstances, the Seller is unable to deliver the goods ordered in the online shop, the Seller shall have the right to terminate the Sale and Purchase Agreement by notifying the Buyer in advance. The Seller may offer a similar product. If the Buyer refuses, the Seller undertakes to refund the money paid within 3 working days.
4.4. if the Buyer has exercised the Terms and Conditions 5.2. the right provided for in Clause 4.1, the Seller undertakes to refund the money paid to the Buyer within 5 (five) working days from the date of receipt of the returned goods.
4.5 The Seller may withhold any refund to the Buyer until the Goods have been returned to the Seller or until the Buyer has provided proof that the Goods have been dispatched to the Seller, whichever is the earlier.
5. Buyer's rights
5.1 The Buyer shall be entitled to purchase the Goods in the Online Shop in accordance with these Terms and Conditions.
5.2 The Buyer shall have the right to withdraw from the contract for the purchase of goods concluded in the online shop by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.
5.3. 5.2 The Buyer may only exercise the Buyer's right under point 4.1 if the goods have not been damaged or substantially altered in appearance and have not been used.
6. Obligations of the Buyer
6.1 The Buyer shall pay for and accept the Goods purchased in accordance with these Conditions.
6.2 If the Buyer refuses to accept the Goods at the time of delivery without good reason, the Buyer shall be liable for the cost of returning the Goods upon the Seller's request.
6.3 At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the consignment and the Goods(s) together with the Seller or the person delivering the consignment.
6.4 By using the online shop, the Buyer confirms that he/she accepts these Terms and Conditions of Sale and must comply with them.
7. Commodity prices
7.1 The prices of the goods in the online shop shall be quoted in euros. Prices are inclusive of VAT. Once the order has been confirmed, delivery charges, if any, shall be added to the total amount of the goods.
8. Ordering and payment of goods
8.1 The Customer shall, after visiting the online shop, select the goods he/she likes and place them in the shopping cart. After the shopping cart has been created, the Buyer shall enter the personal data necessary for the execution of the order: his/her name, surname, the address to which the goods will be delivered, telephone number and any additional information that may be relevant for the delivery of the goods ordered. The Buyer acknowledges that he/she has read these Rules and confirms the order.
8.3.Payments can be made using Swed, Seb, Luminor, Citadele, Šiaulių Bankas electronic banking services, these payment methods are processed by MakeCommerce.lt payment platform. Visa, MasterCard, Amex, Discover, JCB, Maestro, Diners Club, Union Pay, Apple pay and Google pay, iDEAL, Przelewy24, Klarna, Bancontact, Giropay, EPS, Multibanco, Sofort, these payment methods are processed by the Stripe payment platform. "Revolut Pay is processed by the Revolut payment platform. Payments are available in Euro currency.
9. Delivery of goods
9.1 When ordering the Goods, the Buyer must specify the exact delivery address.
9.2 The Buyer must take delivery of the Goods himself. If the Buyer is unable to take delivery of the goods himself, but the goods have been delivered to the address specified by the Buyer, the Buyer shall not be entitled to make any claim for the goods having been delivered to the wrong person.
9.3 The Seller shall deliver the Goods to the Buyer in accordance with the terms specified in the descriptions of the Goods.
9.4 The characteristics of all goods sold shall be set out in the description accompanying each item. The Seller shall not be liable for the fact that the colour, shape or other parameters of the goods in the online shop may not correspond to the actual size, shape and colour of the goods due to the characteristics of the monitor used by the Buyer.
9.5 In the event that the Buyer withdraws from the contract for the sale of goods, the Buyer shall be refunded all sums paid by the Buyer, including the delivery costs paid by the Buyer.
10. Returning goods
10.1 Goods will only be returned if it is proven that the goods were damaged or sent in poor quality before reaching the Customer. Please check that the "quality sticker" is not cut/torn off before collecting the parcel from the courier/delivery office. Take a video of the unpacking of the goods, otherwise we will not accept any attempted return without footage.
10.2 Goods of good quality may be returned within 14 days of receipt. The defects of the goods sold in poor quality shall be eliminated, the poor quality goods shall be replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.3 The following conditions must be complied with when returning goods:
10.3.1.The returned goods must be in their original packaging in good condition (this does not apply in the case of returns of low-quality goods);
10.3.2. the Goods must be in good condition and not damaged by the Buyer;
10.3.3. the goods must be unused and in good condition: labels must be intact, protective films must be intact, etc. (this point does not apply in the case of a return of low-quality goods);
10.3.4.The returned goods must be in the same condition as when received by the Buyer (this clause does not apply in the case of a return of low quality goods);
10.3.5 The Seller shall have the right to refuse to accept the Buyer's return of the Goods if the conditions for the return of the Goods have not been met;
10.3.6.The return of the Goods shall be carried out in the manner prescribed by the Seller within 14 (fourteen) days from the date of receipt of the Goods (this clause does not apply in the case of low-quality Goods, in which case the return of the Goods shall be carried out within the statutory warranty period);
10.3 Returns and replacements of goods of satisfactory quality shall be made in accordance with Article 6.22810(1) of the Civil Code;
10.4 Money paid for Goods accepted by the Buyer but subsequently rejected shall be refunded to the Buyer's account no later than 5 (five) days after the Goods have been returned to the Seller, unless the Seller and the Buyer agree otherwise.
10.4 The Buyer bears all costs related to the return process (delivery of the goods to the Seller and a one-off return processing fee (€5.95)).
11. Final provisions
11.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.
11.2 These Terms and Conditions and the relationship between the Parties hereto shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
11.3 All disagreements arising out of the application of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4 The Parties shall be excused from performance of their obligations hereunder if such performance is prevented by unforeseeable circumstances beyond the control of the Parties (Force Major).
